Utilisation of the technological means, a new right of the managed: validity and efficiency

Abstract

The Legislative Decree 856 is issued on December 15, 2017, containing the first Administrative Procedures Law in El Salvador; law that has been in effect since February, 2019 and mainly develops the general administrative procedure that must be observed by the entire Public Administration, but also it proposes the principles to which it must be subjected the mentioned “PA ”. Here it empowers the citizen of a series of rights, in order to make it easier for the citizen to interact with it and as a consequence, make effective the administrative function and the administrative supervision efficient. One of the rights that are positivized in favor of the citizen is relating to the “PA” through electronic means and this is the right that I will deal with in this paper; It will be started by presenting it as an instrument of the right to information and the right to access public information mainly; then this new right will be shown as an expression of the principle of antiformalism to which the PA is subject and as it appears as a transversal axis in the content of the PAL , enhancing the right to good administration.
